Why it's in your best interests to use a "Buyer's Broker" to work for you:

Most New Mexico real estate brokers will give potential buyers tremendous, dedicated service at no cost to the buyer,  with or without fiduciary responsibility, if a written agreement protects the broker and notifies the seller that the agent is dedicated to the buyer even though the seller is paying them. This is a great deal for real estate buyers because they are getting a great deal of service, time and expense, dedicated to them. Most New Mexico real estate agents will work their tail off for you.

New Mexico state law requires that you be given a formal notice, explaining various "agency" relationships you can have with real estate brokers, any time it looks like something is going to be put in writing involving real estate. This notice provided by the Realtor's Association of New Mexico, explains the regulations of the New Mexico Real Estate Commission regarding "agency" relationship. This information can effect you if you are thinking about buying or selling real estate in Santa Fe  New Mexico. To read it click on:

 In the past, most real estate agents showing properties to 

buyers were actually sub-agents of the seller's agent. This was because attorneys said an agent was working for who ever was paying them, and they therefore owed fiduciary responsibility to the seller. This some times confused buyer's because they often thought the agent was working for them. It also caused ethical conflicts and legal vulnerability to agents who really wanted to operate in the best interests of their buyers, but had fiduciary responsibility to the sellers. To solve these problems, some new arrangements were formalized that gave exclusive representation to buyer's, "Buyer's Agency" or "Non-Agency".

If there is an agreement, in writing, creating a "Buyer's Agency" or exclusive "Non-Agency" relationship between the buyers and the broker, and the seller is notified in writing of this relationship, the real estate broker  can operated in the best interests of the buyers, even though the seller is paying them, and it costs the buyer nothing for the broker's services (if the agreement states that). This has obvious advantages to you as a buyer. If you really want definitive advice on agency relationships, ask your attorney.

I have been helping people buy and sell real estate in Santa Fe and northern New Mexico, for a long time (1984). If you wanted my help, I would enter your criteria into my computer system and search the Santa Fe Association of Realtors Multiple Listing Service. Then search for target properties every day. The latest property data is downloaded at 3:00AM every morning. I then use my experience and a process of elimination to come up with a list of properties that fit your needs. When you find one you like, I do a market analysis on it (just as for a seller) based on "sold comparables" so you can get an accurate idea of what it's really worth, and I'll tell you what I thought was wrong with the property.  I would then guide your transaction through every step from price negations to closing.
